ABSRACTS

 

Safeguarding the High Station of the Assembly of Experts

by the editor

In talking about the important position of Experts, suffice it to say that
selecting the leader of the Islamic Ropublic is the primary duty of this
institution.

The editor draws special attention to the significance of conducting
appropriate selection and discusses its special importance in the sensitive
period following Imam's departure. He also stresses the necessity of making
hard efforts to pave the way for the presence of the people who played
a major role in the Revolution in order to establish a very efficient Assembly
of Experts. In an attempt to help achieve the mentioned goal, two published
issues of this journal, The Islamic Government, have been devoted to
this subject.

The Assembly of Experts in the View of Imam Khomeini and the Grand Leader

The ûimportance‎ of a certain subject can be viewed from two sides: first,
the sensitivity and opposition shown by the opponents which marks the special

effect of the subject in question and shows its inconsistency with their aims
and second, the confirmation, explanation and special caution of sincere
supporters who draw the nation's attention to the significant status of the
subject so that they may realize its value, work hard to safeguard it and stand
against any danger or deficiency that may come in its way.

The important position of the Assembly of Experts is one of the subjects
on which both sincere insiders and spiteful and revengeful outsiders
(foreigners) and alternative thinkers have elaborated and each group has
expressed its own views about it. We are not going to deal with these views in
this brief discussion. We will focus in this essay on the speeches delivered by
two of the important eminent personages, whose words about this subject are
considered more ``authentic'' than those of the others and of more influence
on safeguarding the Assembly of Experts.

One of these two is Imam Khomeini, the principal architect of the Islamic
Revolution and the other is the Grand Leader who is the righteous successor
of Imam Khomeini and the standard-bearer of Imam's path who has accepted
the responsibility of safeguarding the heritage left by late Imam Khomeini
and fulfilled his duty determinedly and successfully.

The Assembly of Experts in the Islamic Republic

(an interview with Ayatollah Hashimi Rafsanjani)

part one

Ayatollah Akbar Hashimi Rafsanjani is a member of the Assembly of
Experts and he has been the deputy-head of this very imporant institution for
three successive terms. Among the questions of this interview with Ayatollah
Rafsanjani are the status of this institution in the framework of the political
system, the philosophy of founding this institution, its relation with the
legitimacy of the political system and finally the kind of activities it has. The
deputy-head of the Assembly of Experts made clear his ideas in a scientific

meeting attended by a number of learned figures such as Hojat al-Islam
Muhammad Sorush Mahalati, Hojat al-Islam Seyyed Mas`ud Ma`sumi and
Dr.Kadkhoda`i.

Without doubt, an acquaintance with the Assembly of Experts as a
newly-established cinstitution, its status and its activities requires that
scientific meetings will be held and effective experienced members of this
important institution will take part in it.

The Necessity, Position and Activities of the Assembly of Experts

(an interview with Ayatollah Imami Kashani)

The ``necessity of having the Assembly of Experts'' within the framework
of the Islamic Republic, the status and the activities of this institution as well
as the people's expectations from those for whom they vote for are among
the main issues which were discussed in the interview with Ayatollah
Muhammad Imami Kashani, who has been a member of the Assembly of
Experts for three successive terms and is one of the jurisprudents of the
Council of Guardians. The interview also include some of his reminiscences of
the special meeting of the the Assembly of Experts in its first term when
Ayatollah Khamene'i was chosen as a leader. The reader finds in this issue a
detailed account of this interview.

The Assembly of Experts and the Legality of the Political System

(an interview with Ayatollah Ostadi)

Ayatollah Haj Sheikh Rida Ostadi is one of the members of the Assembly
of Experts who was previously a member of the Council of Guardians. He
discussed in a scientific interview a number of questions such as ``indirect
election of the leader'', ``legal position of the Assembly of Experts'',
``composition of the members of the Assembly of Experts'' and ``source of
authority for determining the eligibility of the Experts''.

In this interview, Ayatollah Ostadi delivers firm rebuttals of the allegations
and questions raised about the Assembly of Experts.

The Legality of the Assembly of Experts

In the Islamic Republic of Iran, accordng to the Constitution when the
Imam of the Age is absent, the responsiblility of guardianship (wilayat-e amr)
and leadership is to be entrusted to a just, pious, brave and competent
jurisprudent who has good acquaintance with his time and is capable of
running the affairs wisely. It is the duty of the Assembly of Experts, whose
members are elected by people, to choose such a person and to observe the
way he deals with people's affairs and acts as a leader.

Therefore, the legality of the Islamic Goverment originates from the
legality of the Experts and the leader whom they choose.

Concerning the criterion of the legality of the Experts' view and their
determination on who enjoys the qualifications required for leadership, three
general rules are taken into consideration:

1. The legality of the Experts requires the confirmation and consent of the
ruling jurisprudent, the supreme leader.

2. The legality of the Experts depends on people's opinion and election.

3. The legality of the Experts has to be in accord with the Islamic law in
order to gain credibility.

The writer examines the three views mentioned above and comments
on them.

Then, he introduces another view, and he observes that, since the Assembly of
Experts has two major duties, i.e. recognizing the eligible supreme leader as well
as selecting him on behalf of the people, so the first duty is conditional on the
view of the experts and the second on people's view, and according to these
two views, the mentioned duties are rendered valid.

Basic jurisprudential Tenets of the Assembly of Experts

What makes the establishment of the Assembly of Experts legally
attested? Does it have a jurisprudential basis of not? What is jurisprudential
basis of the Constitution of the Islamic Republic of Iran concerning founding
the Assembly of Experts?

The present article tries to answer the questions already stated. After
clarifyng certain technical concepts, philosophy and necessity of having the
Assembly of Experts, the writer discusses the proofs of resorting to
experienced religious authority in recognizing the leader and the necessity of
their being well-qualified jurisprudents.

The Legal Position and Role of the Assmbly of Experts in the Poltical
System of the Islamic Republic of Iran

Muhsin Malek Afdali

Due to its special legal status and effective role in governmental system,
the Assembly of the Experts constitutes a unique institution which has an
excellent position in the political structure of the Islamic Republic of Iran.

In his discussion of the Assembly of Experts, the writer casts light on two
points which are as follows:

1. The Assembly of Experts and the Constitution. In this part of the
discussion, the writer reviews the rules of selecting the supreme leader by the
Assembly of Experts and the responsibility it has concerning supervising the
supreme leader's performance.

2. The Assembly of Experts and the rules of election.

The main points, with which this part deals, are the conditions of the elect
and the relationship of the Council of Guardians with the Assembly of
Experts. It also addresses the views of some of the members of the Assembly
of Expert from among the non-mujtahid supporters and from among the

opponents, the constructive and supervisory relationship of the Council of
Guardians with the Assembly of Experts, the supervision of the Counicl of
Guardians over the eligibility of candidates and the Assembly of Experts'
supervision over the proceedings of election.

The Highest Governmental Position and the Method of Selecting a
Governor (a review of the political system in the Islamic Republic of Iran and
in the United States)

The Islamic Republic Government of Iran is a religion-oriented system. It is
also democratic and based on popular vote. The highest governmental position of
this system in which people's view is taken into account through a series of
elections, is held by the supreme leader. Therefore, the leader of the Islamic
Republic Government has to be an extremely well-qualified (eligible) jurisprudent
who is appointed by the Assembly of Experts which is elected by people.

The writer discusses the role and status of the highest governmental
position in the political system of the Islamic Republic of Iran and the
political system of the United States, and he sheds light on the indirect
two-stage method of electing the supreme leader of the Islamic Republic
Government and the indirect method of electing the president of the United
States. The discussion is made up of two parts each of which addresses a
number of points related to the main subject.

The first part which carries the title ``The Islamic Republic Government in
Iran, the Role of the Leader and the Method of Selection'', deals with a
number of issues like the basic principles of Islamic Republic system, the
mechanism of religious democracy, the leader and his role in the Islamic Republic
of Iran, and the Assembly of Experts and its role in selecting aleader.

The second part is given the title,``The Political System of the United
States, the Role of the President and the Method of Seclecting a President''.

The issues on which this part touches are the executive presidential sytem in
the United States, the principle of separation of powers in the American
presidential system, the condition of candidacy for presidency of the United
States, the authority of the Democratic Party and the Republican Party in the
United States, etc.

The Islamic Repulic and the Assembly of Experts

(a written account of a dialogue between Sharifi and Qadi Zadeh)

(part one)

As a new experience in the world's political governmental systems ``Islamic
Republic'' was founded for the first time by Imam Khomeini after the Islamic
Revolution of the Iranian nation. In this political system, national sovereignty
is exercised within the framework of Islamic values and edicts. The allegation
of the conflict between ``national sovereignty'' and ``religious sovereignty'' has
been fequently raised since the early days of the estblishment of the Islamic
Republic, and in spite of the rebuttals delivered in this respect, this frequently
raised allegation has various forms.

As a result,different explanations were introduced as to how these two are
compatible with one another.

The Islamic Government presents a written account of the dialogue
between two researchers who discussed the questions of ``Islamism'' and
``republicanism'' and exchanged opinions about this topic. Due to the fact
that the election of the Assembly of Experts in its fourth term will be in the
near future, the issue of ``The Assembly of Experts and the position and criterion
of its legality'' was discussed too, and the two researchers presented their different
ideas in regard to the role of people in relation to this institution.

This journal would like to thank both Mr. Ahmmad Husayn Sharifi and
Kazim Qadi Zadeh who took part in the dialogue and answered the questions
set by the journal. We also invite those who are interested in this subject to
read the dialogue, which is to appear in the two issues of this journal.

Ar Account of and Critical Remarks on the Book ``Imami Jurispradents
and the Realms of the Guardianship of the Juris pradent

At the outset, the author introduces a brief account of the
above-mentioned work. He appreciates the efferts of those who contributed
to it and refers to the weakpoints he detects in it.

In his critical study of this work, the researcher points out a number of
shortcomings including biased selection, incomplete transmission,
misconceptions, omission of the question of lack of guardianship (Wilayah),
lack of derivation of Jurisprudential tenets, no reference to the distinction
between the age of Imam's presence and the time of his absence, and
insufficiency of documentation.

The journal introduces a collection of articles on Islamic political thought
and jurisprudence which have been taken from many of the publications
published in the spring of the year A.H.(solar) 1385. The materials have been
selected from various sources other than the journal of Islamic Government.
The articles appear in chapters and are classfied according to the following
headings: political philosophy, general political thought, political
jurisprudence, politics and government at the time of the presence of Imam,
politics and government at the time of the occultation of Imam, constitutional
law and politicians and statesmen.

The index of this issue consists of 577 articles on Islamic political thought
and jurisprudence.
